The South Dakota standard recently published an article by Rapid City attorney Jay Shultz, who is running for State House of Representatives in District 34.

In his article Jays states”

Due to automatic changes in several South Dakota statutes triggered by the Supreme Court decision overturning Roe v. Wade, most abortions at any stage of the pregnancy are no longer “authorized by law” except to save the life of the pregnant woman.

This means that most, if not all, first-trimester abortions would be classified as “first-degree murder” since the fertilized egg is defined as an “unborn child” and it normally would be too early in the pregnancy to accurately determine whether the pregnant woman’s life was in danger.
